Bola Tinubu, the presidential candidate of the All Progressives Congress on Thursday, described himself as “unbreakable” following the dismissal of a suit challenging his candidacy by a Federal High Court in Abuja.

The action brought by the Action Peoples Party (APP) sought to invalidate his nomination as the APC presidential candidate for the 2023 election.

But the court on Wednesday struck out the case seeking to nullify Tinubu’s candidature.

The APP and other parties filed the lawsuit numbered FHC/UM/CS/124/2022 with the Independent National Electoral Commission as the first defendant, Tinubu as the second defendant, and the APC as the third defendant.

The plaintiffs had asked the court to order INEC to revoke Tinubu’s nomination as the presidential candidate of the APC, the third defendant.

The plaintiffs alleged that Tinubu, a former governor of Lagos State, provided false information to the INEC in his form EC9 by failing to include details of his primary and secondary education as contained in his form CF001 of 1999 submitted for the governorship election in accordance with Section 29 of the Electoral Act 2022 and Section 131 of the 1999 Constitution of the Federal Republic of Nigeria.

However, Justice Emeka Nwite of the Federal High Court in Abuja dismissed the case on Monday for “lack of diligent prosecution.”

Tinubu praised the court’s decision in a post made through Bayo Onanuga, the Director of Media and Publicity for the APC Presidential Campaign Council (PCC).

“Tinubu, the unbreakable man wins again by overcoming the machinations of the enemies,” Onanuga wrote on his Facebook page.
